AZUR – FULL TERMS & CONDITIONS

ARTICLE 1 – IDENTITY OF THE ENTREPRENEUR

Hereinafter referred to as: “AZUR”.

ARTICLE 2 – APPLICABILITY

2.1 These Terms and Conditions apply to every offer made by AZUR and to every distance contract concluded between AZUR and a consumer.

2.2 A “consumer” means any natural person acting for purposes outside their trade, business, craft, or profession.

2.3 Deviations from these Terms are only valid if agreed in writing.

2.4 If any provision is invalid, the remaining provisions remain fully enforceable.

ARTICLE 3 – OFFER & PRODUCT INFORMATION

3.1 All product descriptions are as accurate as reasonably possible.

3.2 Minor deviations in colour, structure, or finish due to screen rendering or production variations do not constitute non-conformity.

3.3 Obvious errors or manifest mistakes in pricing do not bind AZUR.

3.4 AZUR reserves the right to modify the website and product assortment at any time.

ARTICLE 4 – FORMATION OF THE AGREEMENT

4.1 The agreement is concluded when the consumer completes checkout and payment is successfully processed.

4.2 AZUR will confirm receipt of the order electronically.

4.3 AZUR reserves the right to refuse or cancel orders in cases of:

  • Suspected fraud
  • Incorrect pricing
  • Payment irregularities
  • Stock errors

If payment has been made, it will be refunded without undue delay.

ARTICLE 5 – PRICES & PAYMENT

5.1 All prices are stated in EUR and include VAT where applicable.

5.2 Shipping costs are stated separately before order confirmation.

5.3 Payment must be completed before shipment unless otherwise agreed.

5.4 Accepted payment methods are displayed at checkout.

5.5 In the event of non-payment, AZUR may suspend or cancel delivery.

ARTICLE 6 – DELIVERY

6.1 AZUR will dispatch orders within a reasonable timeframe.

6.2 Delivery times are indicative and not strict deadlines.

6.3 The maximum delivery period is 30 days unless otherwise agreed.

6.4 Risk transfers to the consumer at the moment of delivery.

6.5 For deliveries outside the EU, import duties and taxes are the responsibility of the consumer.

ARTICLE 7 – RIGHT OF WITHDRAWAL (EU CONSUMERS)

7.1 The consumer has the right to withdraw from the agreement within 14 days without giving reasons.

7.2 The withdrawal period begins:

  • The day after receipt of the product
  • Or, for multiple shipments, the day after the final item is received

7.3 The consumer must notify AZUR within the withdrawal period.

7.4 The product must be returned within 14 days after notification.

7.5 The consumer must handle the product only to the extent necessary to assess its nature and characteristics.

7.6 The consumer is liable for any diminished value resulting from handling beyond what would be permitted in a physical store.

ARTICLE 8 – REFUNDS

8.1 AZUR will refund all payments received, including standard delivery costs, within 14 days after withdrawal notification.

8.2 AZUR may withhold refund until:

  • The product is received, or
  • The consumer provides proof of return shipment

8.3 Refunds are issued via the original payment method unless otherwise agreed.

ARTICLE 9 – AZUR 30-DAY VOLUNTARY RETURN POLICY

9.1 In addition to statutory withdrawal rights, AZUR offers a voluntary 30-day return window.

9.2 Returns must be:

  • Unworn
  • Unwashed
  • In original condition
  • With tags attached

9.3 Free returns apply within the Netherlands.

9.4 Outside the Netherlands, return shipping costs are borne by the consumer.

9.5 AZUR reserves the right to assess returns on a case-by-case basis in line with its brand values of fairness and reasonableness.

ARTICLE 10 – EXCLUSIONS FROM WITHDRAWAL

The right of withdrawal does not apply to:

  • Custom-made or personalised products
  • Sealed goods not suitable for return for hygiene reasons once opened
  • Products irreversibly mixed with other items
  • Digital content once accessed

ARTICLE 11 – WARRANTY & CONFORMITY

11.1 AZUR guarantees that products conform to the agreement.

11.2 Consumers are entitled to statutory conformity rights under EU law.

11.3 AZUR provides a 24-month warranty covering manufacturing defects and material faults.

11.4 The warranty does not cover:

  • Normal wear and tear
  • Damage due to improper washing
  • Misuse or accidents (see crash policy)
  • Failure to follow care instructions

11.5 Remedies may include:

  • Repair
  • Replacement
  • Refund

The chosen remedy shall be proportionate and reasonable.

ARTICLE 12 – LIABILITY

12.1 AZUR is not liable for indirect, consequential, or incidental damages except where mandatory law provides otherwise.

12.2 AZUR’s liability is limited to the value of the order.

12.3 Nothing excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud
  • Mandatory consumer protections

ARTICLE 13 – FORCE MAJEURE

AZUR is not liable for failure to perform due to circumstances beyond reasonable control, including but not limited to:

  • Supply chain disruption
  • Transport delays
  • Government restrictions
  • Natural disasters

ARTICLE 14 – INTELLECTUAL PROPERTY

All content, trademarks, designs, and materials remain the exclusive property of AZUR.

ARTICLE 15 – PRIVACY & DATA PROTECTION

15.1 AZUR processes personal data in accordance with GDPR.

15.2 The AZ UR Foundation operates as a separate legal entity.

15.3 No personal data is shared with the Foundation without explicit consent.

ARTICLE 16 – DISPUTES & GOVERNING LAW

16.1 Dutch law applies.

16.2 EU consumers may rely on mandatory provisions of their country of residence.

16.3 The European Online Dispute Resolution platform is available.
